Terms and Conditions for Online Auctions

Payment Terms: A 15% buyers fee and applicable sales tax will be added to all purchases (sales tax will not be charged on vehicles or if you are tax exempt and provide a copy of your state issued Sellers' Permit/Tax ID certificate) a 5% discount will be incorporated when paying with cash, check. Successful bidders will receive an email invoice within 24 hours of the auction close. Full payment is required within 5 business days of the invoice date. Accepted payment is Cash, Bank-guaranteed checks/drafts, Money order, Personal or Company Check Only with bank letter guarantee, payable to Kigar Auction, 500 South Madison Street, Delta, OH 43515. Any returned check will incur a $35 charge. Visa/MasterCard purchases are limited up to $5,000. Call our office at {419-822-5590} if you are paying with your credit card.Full payment must be made and properly honored before any auction item will be released to buyer.

The Bidder, grants the Auction Company a standing authorization to charge the Bidders credit card after 5 business days of the invoice date for any and all costs, fees, buyers premiums, storage disposal fees as well as for any other costs, charges and/or fees incurred. We charge a $100 processing fee for processing credit card chargebacks that are ultimately reversed in our favor.

Any asset involving a title will be held until funds have been verified. Titles must be assigned to the buyer or some other identity.

Internet bids are a contract and you are responsible for honoring them. If you cannot satisfy these terms, please do not bid.

Disclaimer: All items sell "AS IS - HOW IS - WHERE IS." Kigar Auction does not give any type of guarantee or warranty, implied or otherwise. While all lots are described as accurately as possible, do not solely rely on any descriptions provided by the Seller, nor Kigar Auction. Kigar Auction encourages all bidders to personally inspect all items themselves BEFORE BIDDING! It is the sellerís responsibility to provide Kigar Auction with accurate descriptions and may be subject to errors or omissions. Any errors are not sufficient grounds for returning any purchased item. There are no returns, refunds, or adjustments. THE ENTIRE RISK AS TO THE QUALITY, AUTHENTICITY & CONDITION RESTS WITH THE BUYER. Both the seller and/or Kigar Auction reserve the right to withdraw any auction items at any time and/or extend the auction duration. Some items may have a reserve or minimum and will not be sold unless the reserve or minimum price has been obtained. Kigar Auction reserves the right to reject any and all bids.

All Sales Final, if paying by check, shipping will occur after check clears. Buyer is responsible for shipping and handling cost.

Removal: Time will be posted or within 3 days after payment. A PAID RECEIPT from Kigar Auction is required for pickup. High bidder must pickup at the designated location. Buyer is responsible to provide all labor, tools and equipment needed to remove all items. Merchandise becomes the full responsibility of The Buyer at the time of sale and The Buyer assumes all risk of loss and damage to property until removed from the sale premises. Owner/Seller and Kigar Auction agree that merchandise may remain on the premises for a determined period of time following the sale. The date by which all merchandise must be removed from the premises is posted on an auction-by-auction basis, on the specific auction page. After the final removal date, there will be a $5.00 per day, per item storage fee charged to The Buyer up to ten days. If merchandise is not removed within ten days after the final removal date, the ownership of the merchandise will revert back to the original Owner/Seller and the Owner/Seller may dispose of the item at their discretion.
